Histórico: Desmond Tutu llama a Israel a liberarse

Queridos amigos y amigas,

Esta es la primera vez que enviamos un artículo de opinión a nuestra comunidad, pero la ocasión lo merece.

El Arzobispo Desmond Tutu acaba de publicar un potente llamamiento a la conciencia en un periódico Israelí. En su artículo, el premio Nóbel y leyenda de la lucha contra el apartheid se une a los 1.6 millones de personas que estamos pidiéndole a grandes multinacionales que boicotéen y retiren sus inversiones de toda actividad relacionada con la represión y ocupación del Israel sobre Palestina.

Su humanidad y su amor brillan en cada párrafo, mientras urge a los ciudadanos de Israel (el 87% de los cuales apoyan los bombardeos sobre Gaza) a “liberarse” de este terrible statu quo. Su lectura es indispensable.

El texto sólo puede leerse en el periódico Israelí, pero es una pieza importante para legitimar una posición que algunos gobiernos aún consideran controvertida, y el resto del mundo necesita leerla. La única manera de conseguirlo es compartiéndola entre nosotros. Hagámoslo.

Y sorprendentemente, el mismo Gobierno estadounidense acaba de congelar el envío de misiles hellfire a Israel.

Para nosotros es increíble alzar la voz junto con Desmond Tutu una vez más. Porque es un formidable líder pacifista, y porque en un mundo asolado por los extremistas que tan a menudo logran demonizar al “otro”, la lucha no violenta es fundamental para lograr el cambio. Se requiere una enorme fortaleza para mantenerse firme a favor de la justicia, pero desde el amor hacia todas aquellas personas que se niegan a convertirse en víctimas del miedo y la ignorancia que conforman nuestro enemigo global más temido.

Se necesita un sentimiento de amor que reconozca que los destinos y la libertad de cada uno de nosotros están fuertemente entrelazados. Éste además de ser el espíritu que nos han enseñado líderes increíbles, como Gandhi o el propio Tutu, es el hilo desde el que esta comunidad tira en cada una de nuestras campañas.

Is Germany’s pursuit of ‘Mossad agent’ a bit heavy-handed?

BERLIN – Shimon Stein, a former Israeli Ambassador to Germany, told The Jerusalem Post on Wednesday that the decision of Germany’s top prosecutor to issue an extradition order for an alleged Israeli spy – reportedly involved in the forgery of a German passport used to travel to Dubai to assassinate Hamas arms smuggler Mahmoud al-Mabhouh – should not be seen “in isolation but in a broader context of growing displeasure with Israeli conduct.”

On June 4 in Warsaw Polish authorities arrested a man using the name Uri Brodsky who is suspected of working for the Mossad in Germany.

Stein said that German Foreign Minister Guido Westerwelle “spoke at an early stage for clarification” in connection with the murder of Mabhouh.

“Germany was a bit embarrassed, to put it mildly...there were too many footprints suggesting we are behind it,” said Stein.

He added that”incidents in the past could be ironed out” but “someone had an interest to leak” the arrest of the alleged Israeli agent.

It is unclear who leaked the capture of the alleged intelligence officer in Warsaw to the magazine Der Spiegel. When asked about reported diplomatic strains between Israel and Germany, Stein said there are “those interested in bringing those frictions to the fore.”

When questioned if the extradition order caused diplomatic friction between Israel and Germany, a spokesman for the German Foreign Ministry, in an email to the Post on Wednesday said, “there are no diplomatic tensions between Germany and Israel.”

The thorny issue of whether Germany is unfairly clamping down on the intelligence activities of its ally Israel while ignoring the presence of terrorists in the Federal Republic surfaced in the German media. Writing in the large daily Die Welt on Wednesday, Norbert Jessen, a veteran reporter covering German-Israeli relations, noted ,“Even the presence of known international terrorists from Middle Eastern states on German soil does not always lead to their immediate arrest. They are often left alone even without diplomatic passports.”

Stein a fellow at the Institute for National Security Studies (INSS) in Tel Aviv, noted that German Chancellor Angela Merkel usually “takes a low profile” but called for “an international inquiry” after Israel’s seizure of the Gaza flotilla.

“The atmosphere is not conducive” to Israel in the Federal Republic.

“While things went well for so many years” with respect to the so-called German-Israeli special relationship , the “winds are not blowing in our direction” at this time, said Stein, a leading authority on German-Israeli relations.

When asked about the arrest of the alleged Mossad agent and the role of Germany, the Israeli Embassy in Berlin declined to comment.

A spokesman for Germany’s top prosecutor told the Post on Wednesday that “the Polish authorities will decide” if the alleged intelligence agent will be extradited to Germany.

By e-mail to the Post, the German prosecutor’s office wrote that the office “is conducting an investigatory process “ involving “the alleged secret service background of the acquisition of a German passport.” Citing provisions of German law, the prosecutor’s statement said the investigative process is based on the “suspicion of activity of a foreign agent and indirect false certification.”

If the Polish authorities extradite the alleged Israeli spy to a court in the German city of Karlsruhe , where the Federal German prosecutor’s office is based, three judicial possibilities would unfold.

The agent could be imprisoned during the legal process or the arrest order could be revoked, resulting in the agent’s release. The third possibility is he could be stripped of his passport and the court could set bail to avoid incarceration while he waits for the judicial inquiry to issue its determination.

Iran's leaders continue to reject compromises over their nuclear program and are rebuffing the IAEA. The West is likely to respond with tighter sanctions, but that is unlikely to satisfy Israel, which has attack plans already drawn up.

Six men are sitting around a table, deciding the future of the world. The men, who represent the US, Russia, China, France, Britain and Iran, are considering questions such as: Is Tehran really building a nuclear bomb? Do sanctions work, and if they do, how should they be intensified? Will bombing the Iranian nuclear facilities end up being the only real solution, and what would be the consequences?

The men are not politicians, but scientists and diplomats involved in a role-playing scenario. They are all Israeli citizens. That doesn't make the experiment, which took place two weeks ago at the Institute for National Security Studies in Tel Aviv, any less spectacular. The participants in this role-playing exercise, all of whom were very familiar with the issues involved, were capable of taking a completely different approach to what-if scenarios than politicians, because they cannot be held responsible for anything -- good or bad -- that results from their decisions.

The outcome of the experiment was supposed to be kept secret, but this much was leaked: The participant playing the United States emphasized negotiations and shunned confrontation for a long time, while "Iran" was convinced that it had excellent cards and viewed the risk of truly hard-hitting sanctions as slim. "Israel" initially pushed for international isolation and crippling economic sanctions by the United Nations, but then -- as a last resort -- threatened to attack.

Plans at the Ready

The results probably pleased Israeli Prime Benjamin Netanyahu, because they reflected the way he thinks. Although the premier is not yet prepared to deploy Israeli fighter jets to conduct targeted air strikes on Iran's nuclear facilities, the military has plans at the ready.

Netanyahu has said often enough that he will never accept an Iranian nuclear bomb. He doesn't believe Iranian President Mahmoud Ahmadinejad when he insists that Iran's nuclear program is intended solely for civilian purposes. But he does take Ahmadinejad -- a notorious Holocaust denier -- at his word when he repeatedly threatens to wipe out Israel. Netanyahu draws parallels between Europe's appeasement of Hitler and the current situation. "It's 1938, and Iran is Germany," he says. This time, however, says Netanyahu, the Jews will not allow themselves to be the "sacrificial lamb."

But even politicians who normally take a less extreme view, like Deputy Prime Minister Dan Meridor, Israel's minister of intelligence and atomic energy, are now realizing that the situation is coming to a head. A narrow majority of the Israeli population currently favors bombing the Iranian nuclear facilities, while 11 percent would consider leaving Israel if Tehran acquires nuclear weapons.

Meridor says that his counterparts in the US government are reporting a sharp increase in the level of concern among Iran's moderate Arab neighbors. "Ninety percent of the conversations between the United States and countries like Egypt and Saudi Arabia now revolve around Iran, while 10 percent relate to the Israeli-Palestinian conflict," he says.

Decisive Stage

This concern is not limited to the region. In Washington and in the European Union -- and, more recently, in Moscow --, the focus has shifted dramatically toward Iran. After years of maneuvering and deception, and after a long period of missed opportunities, including on the part of the West, the conflict is moving toward a decisive stage.

In a SPIEGEL interview in mid-November, US Secretary of State Hillary Clinton said that she had no intention of taking the military option "off the table." Her German counterpart, Foreign Minister Guido Westerwelle, attended a meeting at the Israeli Foreign Ministry last Tuesday, where he was briefed on the latest Israeli intelligence about the Iranian nuclear program. The next day in Vienna, while standing next to Nobel Peace Prize winner and International Atomic Energy Agency (IAEA) Director General Mohammed ElBaradei, who is leaving office this week after heading the UN nuclear watchdog agency for 12 years, Westerwelle said that the international community's "patience with Iran" is "not infinite."

Tehran played a cat-and-mouse game with the IAEA for a long time. However, as a signatory to the Nuclear Non-Proliferation Treaty, Iran has both privileges -- such as technical assistance in the civilian use of nuclear energy -- and clearly defined obligations. The regime has repeatedly failed to live up to these obligations, despite many efforts to build bridges, particularly on the part of ElBaradei. This incurred the wrath of the administration of former US President George W. Bush, who even had ElBaradei's telephone conversations tapped.

In its most recent internal report, dated Nov. 16, 2009 and marked "for official use only," the IAEA has adopted an unusually sharp tone. According to the report, the Fordo uranium enrichment facility near the city of Qom in northwestern Iran, which the UN inspectors only discovered in September, was "clearly reportable," because it had apparently been under construction for much longer than the Iranians had indicated. A possible military nuclear program, which the Iranian leadership has consistently denied, raises "alarming" questions, according to the report, while Tehran continues to refuse to permit unannounced inspections. In summary, the report states: "Iran has not fulfilled its obligations. Its behavior is not conducive to the establishment of trust."

En la guerra de Gaza del invierno pasado no hubo color. Israel arrasó, causó 1.400 muertos, gran parte civiles, y destrozó la infraestructura económica de la franja. Pero en el campo político y de la opinión pública, el panorama es diferente. Pese a su feroz campaña diplomática -incluidas tensas conversaciones con primeros ministros de países occidentales-, el Gobierno israelí ha fracasado a la hora de impedir que el informe del juez surafricano Richard Goldstone, que imputa crímenes de guerra a Israel y a Hamás, sea respaldado por el Consejo de Derechos Humanos de Naciones Unidas. Este organismo aprobó ayer una resolución que insta al Consejo de Seguridad a remitir el caso al Tribunal Internacional de La Haya si el Gobierno hebreo y el movimiento islamista palestino rechazan llevar a cabo una investigación creíble sobre las imputaciones vertidas en el informe.

Si los boicoteos académicos, financieros, comerciales y militares a Israel ganan pujanza paulatinamente, en el ámbito de la alta política, el Gobierno de Benjamín Netanyahu ha patinado esta semana con sus socios occidentales. El primer ministro israelí trató de persuadir al secretario general de la ONU, Ban Ki-moon, para que expresara su rechazo al informe. "No puedo intervenir", replicó Ban. Lo mismo intentó con el premier británico, Gordon Brown. Nuevo resbalón. El ministro de Defensa, Ehud Barak, apremió a la secretaria de Estado, Hillary Clinton, para que a su vez convenciera a sus socios en Londres y París. Ni por esas.

Sólo EE UU, Italia, Holanda, Hungría, Eslovaquia y Ucrania votaron en contra de la resolución respaldada por China, Rusia, y hasta 25 países árabes o musulmanes y del tercer mundo. Reino Unido y Francia rechazaron participar. Otros 11 Estados se abstuvieron.

En Israel el asunto suscita enorme preocupación. No porque piensen que el expediente concluya finalmente en el Tribunal Penal Internacional. Antes debería tramitarse en el Consejo de Seguridad, instancia en la que el veto estadounidense podría jugar su papel tradicional. Pero, ¿ha echado Washington toda la carne en el asador para impedir que prosperara la resolución? EE UU se opuso, sí, pero al igual que Londres y París -que eludieron votar en contra- ha presionado al Gobierno israelí para que forme una comisión de investigación, precisamente lo que exige el informe Goldstone. Es evidente que Netanyahu no disfruta del beneplácito a ciegas de Barack Obama del mismo modo que su antecesor, Ehud Olmert, tuvo el de George Bush.

El requerimiento al movimiento islamista carece de relevancia. Sería impensable que Hamás -que animó a "perseguir en los tribunales a los criminales sionistas"- negara su implicación en el disparo de cohetes contra suelo israelí. Pero será igualmente complicado que el Gobierno de Netanyahu acepte crear una comisión de investigación. Se niega, entre otros motivos, porque ello supondría desacreditar a su Ejército, que asegura haber investigado lo sucedido y rechaza toda responsabilidad. Casi nadie en el mundo concede legitimidad a una investigación de quien se constituye en juez cuando además es parte. A juicio de la cancillería israelí la decisión del consejo es "injusta" y "alienta el terrorismo". Así las cosas, la disputa en el organismo internacional supone otro escollo -Israel ha advertido de que bloqueará las negociaciones aún no nacidas si el proceso en la ONU sigue adelante- añadido a los esfuerzos de Obama por relanzar el proceso de paz. Cunde, otra vez, el pesimismo.

Discute el CDH informe sobre invasión israelí

Ginebra. El Consejo de Derechos Humanos de la Organización (CDH) de la Organización de Naciones Unidas comenzó aquí el debate sobre el Informe Goldstone que documentó presuntos crímenes de guerra perpetrados durante la invasión israelí a la franja de Gaza en diciembre y enero pasados, en la que murieron mil 400 palestinos, la mayoría civiles. La votación sobre el reporte está prevista para este viernes. El documento fue elaborado por un fiscal especializado en conflictos armados, el sudafricano Richard Goldstone. Un grupo de 18 de los 47 países miembros del CDH convocó a la discusión del informe, que sugiere llevar a la Corte Penal Internacional los crímenes de guerra perpetrados por las fuerzas invasoras israelíes y la resistencia palestina aglutinada en el movimiento Hamas.

   La aprobación por parte del Consejo de Derechos Humanos (CDH) de Naciones Unidas del conocido como Informe Goldstone, que acusa al Gobierno israelí de perpetrar "serias violaciones contra los DDHH" durante su ofensiva en Gaza a finales de 2008 y principios de este año ha sido condenada sin paliativos por el Gobierno hebreo por ser un ejemplo de "anarquía diplomática" e "incitar al terrorismo", frente al aplauso unánime de las fuerzas políticas palestinas en Gaza y Cisjordania, que podrían aprovechar este consenso como un empujón de cara al esfuerzo para la reconciliación nacional.

   La investigación, liderada por el juez sudafricano Samuel Goldstone, halló "pruebas de que Israel y Hamás han cometido serias violaciones del derecho humanitario internacional" durante la campaña de bombardeos y posterior invasión por tierra llevada a cabo por las fuerzas israelíes en la Franja de Gaza y que se cobraron las vidas de 1.400 gazacíes, según ONG palestinas; 1.166 según Israel, 10 soldados y tres civiles israelíes. 

   Un total de 25 miembros del organismo votaron a favor del informe del jurista, mientras que seis lo hicieron en contra y otros 11 se abstuvieron en la sesión extraordinaria celebrada este viernes.

   El informe pide que la cuestión sea tratada en el Consejo de Seguridad de la ONU ante la pasividad de las autoridades palestinas e israelíes frente a las denuncias de violaciones de Derechos Humanos, pero la resolución aprobada este viernes por el CDH sólo pide su consideración en la Asamblea General de la ONU y el examen del secretario general de la ONU, Ban Ki Moon, que deberá informar al propio CDH sobre el cumplimiento por parte de Israel de las recomendaciones del informe.

"ANARQUÍA DIPLOMÁTICA"

   Nada más conocer la aprobación del CDH, el Gobierno israelí ha ratificado su condena al informe, que ha criticado desde el principio de la investigación. El Ministerio de Exteriores rechazó el informe, que calificó de "partidista" y advirtió de que "anima a los grupos terroristas de todo el mundo" y "afecta gravemente a la paz global".

   La votación sobre el Informe ha desembocado, a juicio del viceprimer ministro israelí y ministro del Interior, Eli Yishai, en una decisión "anti-israelí que se suma a un informe ya de por sí anti-israelí". "El Ejército manejó a la población inocente con un guante de terciopelo. La decisión del CDH es un ejemplo de anarquía diplomática", declaró al diario israelí 'Yedioth Aharonoth'.

   De igual modo se expresó el ministro de Ciencia y Tecnología, Daniel Hershkowitz, quien criticó duramente el papel jugado por Naciones Unidas sobre la campaña de Gaza. "Se demuestra una vez más que la mayoría automática de los países árabes en las instituciones de la ONU permite la aprobación de cualquier tipo de resolución distorsionada. Cualquier relación entre esta decisión y la realidad es pura coincidencia. Es una vergüenza el empeño de Naciones Unidas en convertirse en un factor irrelevante", lamentó.

   Fuentes del Gobierno israelí aseguran que, con este informe "se ha perdido una batalla, pero no la guerra". "Esperamos iniciar otras guerras en cooperación con aquellos países que estén expuestos al terrorismo en Afganistán e Irak", según un alto oficial del Ejecutivo israelí, bajo el anonimato.

CONSENSO PALESTINO

   Tanto la Autoridad Palestina del presidente Mahmud Abbas como el movimiento islamista y gobierno de facto en Gaza, Hamás, han celebrado la aprobación del informe en una muestra poco habitual de consenso y que podría facilitar eventualmente las negociaciones de cara a un acuerdo de reconciliación tras la ruptura de relaciones con la toma de poder de la Franja por parte de Hamás en 2007.

   El portavoz de Abbas, Nabil Abú Rudeina, declaró que el informe es la "confirmación del apoyo de la comunidad internacional a los derechos de los palestinos" e instó a la inmediata puesta en práctica de las recomendaciones del Informe y entre las que se incluyen la creación de comisiones independientes israelíes y palestinas para profundizar en los resultados del informe.

   Si bien el Informe Goldstone lamenta en sus conclusiones la falta de participación de ambas partes investigadas, tanto Hamás como la AP han indicado su voluntad de emprender investigaciones internas para dilucidar la actuación de las milicias palestinas durante el conflicto.

   "Esperamos que esta decisión derive en la creación de un organismo dentro del CDH que se dedique a investigar los crímenes de guerra cometidos por Israel", según el principal negociador palestino de la OLP, Saeb Erekat.

   Por su parte, el Gobierno de Hamás ha "aplaudido la decisión, que apoya y expone los crímenes de Israel y la masacre perpetrada contra los palestinos. Para el portavoz de Hamás, Ismail Radwan, se demuestra el respaldo proporcionado "especialmente por los países árabes en el Consejo de Derechos Humanos", según comentó a la agencia de noticias palestina Maan.

UN ESFUERZO DE RECONCILIACIÓN

   Donde si difieren ambos grupos es en sobre la manera en la que que el consenso demostrado a la hora de celebrar en informe influirá en los esfuerzos de reconciliación. Para la Autoridad Palestina, se abre una puerta a la unidad. "Estamos dispuestos a perdonar a Hamás todo lo que ha hecho, pero el precio es la unidad y la reconciliación nacional" apuntó Jibril Rajub, el oficial del partido de Abbas, Al Fatá. "Es hora de que Hamás se dé cuenta de que su postura sobre el informe es una espada de doble filo", añadió.

   En respuesta, el Gobierno de facto de Hamás asegura que el informe no tiene nada que ver con la reconciliación palestina e insiste en su petición de acusar formalmente al presidente Abbas por declarar, hace dos semanas, su intención de retrasar el voto para favorecer el ambiente de las negociaciones de paz con Israel, según el líder de Hamás en Gaza, Mohamed Zahar, en declaraciones recogidas por la cadena británica BBC.

   Egipto ha retrasado la firma del acuerdo para la reconciliación entre Al Fatá y Hamás, debido a que han surgido "nuevas complicaciones", según anunció este viernes una fuente oficial egipcia, que hizo referencia a la creciente tensión entre ambos grupos por la postura del presidente Abbas, respecto al Informe Goldstone.

   Todos los analistas parecen coincidir en que, para bien o para mal, el Informe Goldstone complica las conversaciones para la reconciliación. Varios expertos coinciden además en la necesidad de que el presidente estadounidense, Barack Obama, exprese su opinión sobre el informe, que supone su primera prueba de envergadura tras recibir la pasada semana el premio Nobel de la Paz.

   "Seguimos esperando a que Obama se pronuncie sobre el Informe Goldstone", apunta Mohamed Abú Al Hadid en el diario egipcio 'Al Jumhuriya', resaltando que cualquier comentario del presidente estadounidense en señal de apoyo al informe comportaría graves consecuencias sobre su actual relación con Israel, bastante tensa por la negativa israelí a congelar el desarrollo de sus asentamientos en territorios palestinos ocupados, primera condición para el desarrollo de las negociaciones de paz en la región.

Israeli ambassador to Spain called 'Jew dog' at Real Madrid game

A torrent of anti-Semitic epithets met Israel's ambassador to Spain, Rafi Shotz, Saturday evening as he walked home from a Real Madrid-Barcelona soccer match in the Spanish capital. Shotz said the three perpetrators, patrons of a pub, shouted slurs like "Jewish dog" and "dirty Jew" until they were driven off by Spanish police escorting Shotz.

Shotz and his partner Michal chose to walk from Madrid's Santiago Bernabeu Stadium to their nearby home. Three patrons of a pub noticed the ambassador, whom they apparently recognized from having seen him on television.

In a wire report Shotz sent the Foreign Ministry in Jerusalem under the heading "Anti-Semitism - a personal testimony," Shotz wrote the perpetrators stood mere meters from him, shouting slurs like "Jewish dog," "dirty Jew" and others "which cannot appear in print."

The ambassador and his partner ignored the slurs and continued walking; meanwhile dozens of bystanders watched the scene, but did nothing to stop the verbal assault.

Shotz told Haaretz yesterday, "It was an ugly incident, the kind one hears about or reads about in a newspaper, but to experience personally the force of hatred and anti-Semitism is difficult and emotionally charged."

Spain's ambassador to Israel, Alvaro Iranzo, told Haaretz that "Spanish security forces protected the ambassador and prevented any harm coming to him."

Spain has seen an upsurge in anti-Israel sentiment in recent years, fueled by critical media reports about Israel Defense Forces operations in the West Bank and Gaza Strip, including Operation Cast Lead earlier this year.

After weeks of denying that it used white phosphorus in the heavily populated Gaza Strip, Israel finally admitted yesterday that the weapon was deployed in its offensive.

The army’s use of white phosphorus – which makes a distinctive shellburst of dozens of smoke trails – was reported first by The Times on January 5, when it was strenuously denied by the army. Now, in the face of mounting evidence and international outcry, Israel has been forced to backtrack on that initial denial. “Yes, phosphorus was used but not in any illegal manner,” Yigal Palmor, a Foreign Ministry spokesman, told The Times. “Some practices could be illegal but we are going into that. The IDF (Israel Defence Forces) is holding an investigation concerning one specific incident.”

The incident in question is thought to be the firing of phosphorus shells at a UN school in Beit Lahiya in the northern Gaza Strip on January 17. The weapon is legal if used as a smokescreen in battle but it is banned from deployment in civilian areas. Pictures of the attack show Palestinian medics fleeing as blobs of burning phosphorus rain down on the compound.

A senior army official also admitted that shells containing phosphorus had been used in Gaza but said that they were used to provide a smokescreen.

The Ministry of Defence gave lawyers the task before the attack of investigating the legal consequences of deploying white phosphorus – commonly stocked in Nato arsenals and used by US and British forces in Iraq and Afghanistan – inside the Gaza Strip, home to 1.5 million Palestinians, and one of the most densely populated places in the world.

“From what I know, at least one month before it was used a legal team had been consulted on the implications,” an Israeli defence official said. He added that Israel was surprised about the public outcry. “Everyone knew we were using it, and everyone else uses it. We didn’t think it would get this much attention,” he said.

Because Israel is not a signatory to the treaty that created the International Court of Justice in The Hague, it cannot be tried there. Any country that is a signatory to the Geneva Convention, however, can try to prosecute individuals who took part in the Gaza operation as culpable of war crimes.

Despite a denial when The Times first reported the use of white phosphorus, an army spokeswoman said yesterday that the military had never tried to cover up its deployment. “There was never any denial from the beginning,” she said.

- President Sarkozy of France ordered the deployment of a frigate to international waters off Gaza to patrol against arms smuggling into the territory. Preventative measures against arms trafficking are one of Israel’s demands for a peace deal with Hamas. The warship will conduct surveillance with Egypt and Israel, the French presidency said.

GINEBRA. (EFE).— Durante su última ofensiva en Gaza, Israel incurrió en crímenes de guerra, afirmó ayer el relator especial de la ONU sobre la situación de derechos humanos en esa región, Richard Falk.
El funcionario consideró que Israel debe ser condenado y perseguido por esa situación. Afirmó que es necesaria una condena explícita del Consejo de Derechos Humanos de la ONU, así como que se inicie un juicio penal internacional.

De religión judía, Falk mencionó varias opciones para juzgar al gobierno de Tel Aviv. Una de ellas sería la aplicación de la justicia penal a través de una corte nacional; otra opción sugerida sería que la Asamblea General o el Consejo de Seguridad de la ONU estableciera una corte especial en la Corte Internacional de La Haya como la que juzgó los crímenes en la antigua Yugoslavia o en Ruanda.

La tercera opción sería que Israel fuera juzgado en la Corte Penal Internacional, algo que es “altamente difícil” , dado que Israel no forma parte de esta institución.

En una conferencia telefónica desde Estados Unidos, el relator dijo que “la evidencia de la violación de la ley humanitaria es tan clara que no tengo ninguna duda de la necesidad de una investigación independiente que demuestre que Israel ha cometido crímenes de guerra”.

Desde su perspectiva, los crímenes se agravan por el hecho de que Israel no permitió a la población abandonar el territorio antes de bombardearlo. “No hay precedentes de que una población entera quede bloqueada en zona de guerra y sin posibilidad de huir y de convertirse en refugiados”, explicó.

Israel's Media Management is Not Just Impressive, It's Terrifying
How to Sell "Ethical" Warfare

One of my students was arrested yesterday and spent the night in a prison cell. R's offence was protesting the Israeli assault on Gaza. He joins over 700 other Israelis who have been detained since the beginning of Israel's ruthless war on Gaza: an estimated 230 of whom are still behind bars. Within the Israeli context, this strategy of quelling protest and stifling resistance is unprecedented, and it is quite disturbing that the international media has failed to comment on it.

Simultaneously, the Israeli media has been towing the government line to such a degree that no criticism of the war has been voiced on any of the three local television stations. Indeed, the situation has become so absurd that reporters and anchors are currently less critical of the war than the military spokespeople. In the absence of any critical analysis, it is not so surprising that 78% of Israelis, or about 98% of all Jewish Israelis, support the war.

But eliding critical voices is not the only way that public support has been secured. Support has also been manufactured through ostensibly logical argumentation. One of the ways the media, military and government have been convincing Israelis to rally behind the assault is by claiming that Israel is carrying out a moral military campaign against Hamas. The logic, as Eyal Weizman has cogently observed in his groundbreaking book Hollow Land, is one of restraint.

The Israeli media continuously emphasises Israel's restraint by underscoring the gap between what the military forces could do to the Palestinians and what they actually do. Here are a few examples of the refrains Israelis hear daily while listening to the news:

• Israel could bomb houses from the air without warning, but it has military personnel contact – by phone no less – the residents 10 minutes in advance of an attack to alert them that their house is about to be destroyed. The military, so the subtext goes, could demolish houses without such forewarnings, but it does not do so because it values human life.

• Israel deploys teaser bombs – ones that do not actually ruin houses – a few minutes before it fires lethal missiles; again, to show that it could kill more Palestinians but chooses not to do so.

• Israel knows that Hamas leaders are hiding in al-Shifa hospital. The intimation is that it does not raze the medical centre to the ground even though it has the capacity to do so.

• Due to the humanitarian crisis the Israeli military stops its attacks for a few hours each day and allows humanitarian convoys to enter the Gaza Strip. Again, the unspoken claim is that it could have barred these convoys from entering.

The message Israel conveys through these refrains has two different meanings depending on the target audience.

To the Palestinians, the message is one that carries a clear threat: Israel's restraint could end and there is always the possibility of further escalation. Regardless of how lethal Israel's military attacks are now, the idea is to intimidate the Palestinian population by underscoring that the violence can always become more deadly and brutal. This guarantees that violence, both when it is and when it is not deployed, remains an ever-looming threat.

The message to the Israelis is a moral one. The subtext is that the Israeli military could indiscriminately unleash its vast arsenal of violence, but chooses not to, because its forces, unlike Hamas, respect human life.

This latter claim appears to have considerable resonance among Israelis, and, yet, it is based on a moral fallacy. The fact that one could be more brutal but chooses to use restraint does not in any way entail that one is moral. The fact that the Israeli military could have razed the entire Gaza Strip, but instead destroyed only 15% of the buildings does not make its actions moral. The fact that the Israeli military could have killed thousands of Palestinian children during this campaign, and, due to restraint, killed "only" 300, does not make Operation Cast Lead ethical.

Ultimately, the moral claims the Israeli government uses to support its actions during this war are empty. They actually reveal Israel's unwillingness to confront the original source of the current violence, which is not Hamas, but rather the occupation of the Gaza Strip, West Bank and East Jerusalem. My student, R, and the other Israeli protesters seem to have understood this truism; in order to stop them from voicing it, Israel has stomped on their civil liberties by arresting them.

Israel says its offensive in Gaza could be "in the final act," as it sends top envoys to Cairo and Washington. But German newspapers on Friday look at the prospect for a cease-fire wonder if Hamas won't come out of the violence with a stronger image on the Arab street.

With top envoys dispatched to Cairo and Washington to discuss terms for a cease-fire with Hamas, Israel says its offensive in Gaza is in the "final act." Three weeks of fighting which have left more than 1,100 Palestinians dead could come to an end as the two sides indirectly negotiate a truce via Egypt. Israel launched the attacks on December 27 with the stated aim of halting rocket fire by militants into southern Israel.

Low-level fighting continued on Friday but with less intensity than on Thursday, when Israel seemed to make a last push into the Gaza Strip before a deal was brokered. The relative lull came a day after Israel killed Hamas Interior Minister Said Siam in an air strike and shelled a United Nations compound.

On Friday Israel's chief negotiator, Amos Gilad, flew to Cairo to seek clarifications and express Israeli views on the latest Egyptian proposal for a cease-fire. Sources told Reuters that Israel had rejected some of Hamas' conditions, including its timeframe of 12 months. "A time limit on any period of quiet is a mistake," a senior Israeli source said.

Israel wants Hamas to accept that Western-backed President Mahmoud Abbas' Palestinian Authority be involved in controlling border crossings into Gaza. Hamas, which won parliamentary elections in 2006, ejected Abbas' Fatah party from Gaza after fierce fighting in June 2007.

Meanwhile Israeli Foreign Minister Tzipi Livni, who is hoping to win the parliamentary elections on Feb. 10, has traveled to Washington to hold talks with US President George W. Bush on Friday.

Prime Minister Ehud Olmert's spokesman Mark Regev said the briefings by envoys in Washington and Cairo could be followed by swift decisions by the Israeli Security Cabinet as soon as Friday or Saturday.

"Hopefully we're in the final act," he told reporters.

German newspapers on Friday argue that the international pressure is mounting on Israel in the face of rising civilian casualties in Gaza. Most conclude that Hamas can claim a kind of victory just by holding out in the face of overwhelming Israeli firepower.

The center-right Frankfurter Allgemeine Zeitung writes:

"It doesn't take a prophet to predict that Israel's attack on Gaza is in its final stages. There are reasons for this: Hamas is decisively weakened, which has reinstated the deterrent effect of the Israeli military in the Middle East. In a few days a new American president will take office; Israel will hardly want to do him the injustice of making him cut through the oldest and thorniest knot in the Middle East conflict. The public pressure on Israel is getting stronger because the destruction in the Gaza Strip is growing, including so-called collateral damage. (German) Foreign Minister Steinmeier, on his second trip to the Middle East in a few days, warned that Israel was losing international support. He didn't need to go to the conflict zone to make this assertion, he could have voiced it to Ms. Livni over the telephone -- never mind that the Israelis know it already. Otherwise the journey was unnecessary. It won't bring results, only images for the (German) election campaign."

The center-left Süddeutsche Zeitung writes:

"The Islamists are continuing to fight. They think they can defy the overwhelming power of the Israeli army for a while longer -- even if this is borne by (Gaza's) civilian population. Hamas is waiting for a halfway acceptable offer to end the war."

"The Israelis don't want to give up the economic blockade of Gaza. They want the border with Egypt used by weapons smugglers to be overseen by international monitors. And any reconstruction funds for the destroyed Gaza Strip should be distributed by Palestinian President Mahmoud Abbas. ... Apparently new elections in Gaza are also being considered. Hamas won a clear election victory over Abbas' Fatah party in 2006. On the other hand, Abbas' mandate as president ran out five days ago."

"In short: Part of the cease-fire agreement is obviously intended to deprive Hamas of power. Is the intention to bring Mahmoud Abbas and Fatah back into Gaza? Israel's Foreign Minister Tzipi Livni has often said that the war cannot result in a 'return to the status quo.' However, this kind of cease-fire model is hardly going to push Hamas toward a speedy capitulation."

The left-leaning daily Die Tageszeitung writes:

"Hamas' strength is still not broken. If it survives -- and there is every indication that it will -- then it will celebrate its strategy of digging in as a heroic victory over Israel. And on 'Arab street' it will enjoy a revival. It has held out for three weeks against the overwhelming Israeli firepower … The political compromises that they will have to make for a cease-fire will only damage them marginally if the reward for an effective border control and the halt to rocket fire into Israel is the opening of Gaza's borders."

"Fatah and Palestinian President Mahmoud Abbas have been wrong-footed. Both have been marginalized in this conflict. Abbas was too quick to blame Hamas for the outbreak of the war and so was suspected of collaboration with Israel. Even if this is ridiculous, the accusations of deserting their own people could cost Abbas and Fatah dearly."

Al menos tres personas resultaron heridas durante el ataque, según portavoces de la organización. El español Francesc Claret, funcionario de la organización, explicó a Efe que el Ejército israelí disparó bombas de fósforo contra el inmueble cuando unas 700 personas se encontraban en su interior refugiándose del avance de los soldados israelíes que este jueves entraron en la ciudad de Gaza por primera vez. "Uno de los heridos sufre lesiones provocadas por bombas de fósforo blanco, que atravesaron el chaleco antibalas que llevaba", denunció Claret, quien manifestó su temor porque el incendio no pueda ser sofocado pues el fósforo no debe ser apagado con agua. En el almacén del local se encontraba material de ayuda humanitaria, combustible almacenado. Debido a la situación los vehículos que distribuyen ayuda humanitaria no podrán salir. Los locales de refugio de la ONU se encuentran abarrotados de personas que ante el avance de las huestes homicidas israelíes, bien armados en sus blindados, se ven obligados a abandonar sus hogares en busca de refugio. Los criminales avanzan desde el sur y ya se encuentran en la ciudad de Gaza, donde no respetan a los civiles ni a las normas del derecho internacional humanitario. Contra el hospital Un hospital de la Media Luna Roja Palestina en Gaza fue bombardeado por las huestes sionistas de Israel, según informó la cadena de televisión qatarí Al Yazira, pero no se conoce el número de víctimas. Según Al Yazira, la farmacia del hospital y el segundo piso de un edificio que alberga varias oficinas administrativas en el barrio de Tel Hawa está en llamas como consecuencia de los bombardeos. No quieren testigos de los asesinatos: atacan a la prensa Dos camarógrafos palestinos que trabajan para la televisión de Abu Dhabi resultaron heridos en un bombardeo israelí a un complejo situado en el barrio de A-Shuruk de Gaza capital que albergaba medios de varios países, informó la agencia palestina Maan. Ese lugar funcionaba como centro de operaciones de varios medios árabes y occidentales, entre ellos las cadenas de televisión estadounidense Fox, la británica Sky News y la luxemburguesa RTL, además de agencia de noticias Reuters, y las de las cadenas árabes Al Arabiya y MBC. Se calcula que los muertos ya suman unos 1100, sin contar los que yacen bajo los escombros, y los heridos más de 4000, muchos de ellos mutilados. El secretario general de la ONU, Ban Ki-moon manifestó sentirse escandalizado por los crímenes y expresó su indignación por esos ataques calificando de "inaceptable" la situación en Gaza.

(Y pensar que ya algunos comentan que pase lo que pase será difícil declarar victorioso a Hamas o a Israel. ¿ Y tanto dolor y sufrimiento para eso ? Mas aun, Israel reconoce que Hamas segun una nota que leí hace un momento aun está en condiciones de fabricar/lanzar hasta 200 cohetes al día, es decir tras 15 días de asesinatos judíos no han logrado nada. Al momento se reportan 13 judíos muertos, carajo, ¡ Qué pocos ! 10 militares y tres civiles por cohetes lanzados. Vean el bajo número de muertos por cohetes, y ese es el pretexto de la ofensiva Israel, mentiras y más mentiras de estos mentirosos históricos. Ahora Hamas ha lanzado coehetes desde otras ubicaciones y no necesariamente desde Gaza.)

Reporting from Jerusalem and Khan Yunis, Gaza Strip -- Israeli troops and tanks thrust into the Gaza Strip's densely populated capital from three directions today, drawing Hamas fighters into fierce combat in an offensive expanded by a fresh deployment of army reservists.

The assault on Gaza City coincided with a predawn missile barrage that set 20 homes ablaze in a southern Gaza village. Scores of residents suffered burns and gas inhalation, witnesses said. Doctors who treated the victims said they suspected Israel had fired white phosphorus shells, which can be used to illuminate the nighttime battlefield or to lay down a smoke screen.

Plumes of black smoke rose over Gaza City as Israeli ground forces backed by helicopter gunships inched into neighborhoods on the capital's southwestern, eastern and northern edges before dawn.

Tall apartment buildings shook from the force of Israeli artillery and airstrikes, and Hamas fighters answered with mortars, automatic rifles and grenades. It was the heaviest fighting since Israel attacked the Palestinian enclave Dec. 27, saying it wanted to halt years of rocket attacks on southern Israeli communities.

Troops withdrew from Gaza City after several hours, leaving it unclear whether Israel's leaders had ordered an all-out assault on Hamas' central stronghold. A decision to escalate the offensive would bring in tens of thousands of Israeli reservists, who were called up late last month, into a what would likely be close combat, with sharply higher casualties.

Brig. Gen. Avi Benayahu said today that the army had begun sending some reservists into Gaza but declined to say whether a new phase of the offensive had begun.

On Saturday, Israel's aircraft scattered leaflets over Gaza City and Rafah and sent automated calls to Palestinian cellphones warning of an escalation in attacks.

"The IDF [Israel Defense Forces] will escalate the operation in the Gaza Strip," the messages said in Arabic. "The IDF is not working against the people of Gaza but against Hamas and the terrorists only. Stay safe by following our orders."

The leaflets urged residents not to help Hamas and to stay away from its members.

Also on Saturday, a senior Hamas commander was killed. The army said its ground forces killed Amir Mansi, commander of Hamas' rocket-launching teams in Gaza City, after spotting him at a launch site there. Hamas confirmed Mansi's death.

Palestinian militants fired 15 rockets into Israel, wounding three people.

Diplomatic efforts to end the fighting sputtered as Egypt rebuffed a proposal to place international forces along its border to help prevent weapons smuggling into Gaza. Israel says the offensive is aimed at stopping rocket fire from Gaza and will continue until weapons pipelines into the Hamas-ruled coastal enclave are cut off.

Israeli ground forces invaded Gaza on Jan. 3, after eight days of airstrikes, and have moved to the outskirts of cities. Although there was no sign of an advance, the warnings heightened the panic that has gripped Gaza's 1.5 million people since the offensive began.

On Saturday, scores of families were seen loading mattresses and other belongings into and atop their cars and moving from outlying neighborhoods of Gaza City to places of refuge closer to the center.

In Saturday's bloodiest incident, seven members of the Abed Rabbo clan were killed in the late-morning shelling of their grocery store in a village just east of the Jabaliya refugee camp.

Ziad Barqouni, an ambulance driver, said neighbors told him that the shelling had come from an Israeli tank several blocks away. Barqouni said he saw an Israeli helicopter firing into the village as he approached.

The Israeli army denied attacking the area at the time.

Twelve other Palestinian civilians were reported killed Saturday.

Palestinian medical officials said this weekend that nearly half of the 830 Gazans killed in the offensive were civilians. Israeli news media said the army estimated that it had killed 300 militants.

Thirteen Israelis have been killed: 10 soldiers, plus three civilians hit in Israel by rocket fire.
